1. General
This agreement applies between you, the customer, and Construction Worker Assistance
(“we”, “us”, or “our”), the owner and operator of
constructionworkerassistance.co.uk. By accessing our website, placing an order, or using any of our
services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree
with these Terms, you must cease using our website immediately.
Construction Worker Assistance operates as an independent third-party service provider offering
administrative and support services for CITB test bookings, CSCS card applications, Level 1 Health
& Safety Awareness courses, and CITB revision materials. We are not affiliated with, endorsed
by, or associated with CITB, CSCS, or any official government or regulatory body. A service fee is
charged for the use of our services. We reserve the right to amend these Terms and Conditions at any
time without prior notice.
2. Your Right to
Cancel
Our services are primarily intended for individuals purchasing for work-related purposes. Where
purchases are made for business use, statutory consumer cancellation rights may not apply. Where you
qualify as a consumer, you may have a right to cancel within 14 days unless the service has already
commenced, been completed, or digital content has been accessed.
By placing an order and requesting immediate service, you expressly consent to us beginning the
service without delay and acknowledge that you may lose your right to cancel. Once service provision
has commenced, cancellation rights may no longer apply.
3. CITB Test Booking
Services
By booking a CITB test through our website, you authorize us to act on your behalf to arrange the
booking based on the information you provide. It is your responsibility to ensure that all personal
details are accurate and match your official identification documents. Incorrect or incomplete
information may result in refusal at the test centre without refund. Test dates and times are
subject to availability and cannot be guaranteed. You must attend the test centre with valid
original photo identification and arrive at least 15–20 minutes prior to your scheduled test
time. Failure to attend, late arrival, or failure to provide valid identification will result in the
loss of your booking without refund.
Cancellation requests must be made at least four full working days prior to the scheduled test date.
Where cancellation is made within this timeframe, a deduction of £20 will apply to standard
test bookings (£45), and a deduction of £30 will apply to bookings that include a retake
option (£65). No refunds will be issued for cancellations made within four working days of the
scheduled test date.
Rescheduling is offered free of charge provided the request is submitted more than four working days
before the test date. Requests made within four working days of the test will not be accepted. Where
a retake option has been purchased, only one retest is permitted, and it must be booked within seven
days of failing the test. Retake options are non-transferable. All test results are issued directly
by CITB, and we accept no responsibility for the outcome.
4. CSCS Card
Application Services
Construction Worker Assistance provides administrative support for CSCS card applications. The total
service fee for this service is £65. By placing an order, you authorize us to process your
application using the information and documentation you provide.
If you request cancellation before we begin processing your application, a cancellation fee of
£24 will be charged, and the remaining balance will be refunded. Once the application has been
processed or submitted, it is strictly non-refundable and non-cancellable.
You are responsible for ensuring that all information and documentation provided are accurate,
complete, and valid. Failure to meet eligibility requirements or provide correct information may
result in application rejection, for which no refund will be provided.
Processing times are typically between 10 and 15 working days but may vary depending on third-party
authorities. We accept no responsibility for delays caused by external organizations or postal
services.
5. Submission of
Documentation
Following the purchase of any service requiring documentation, including CSCS card applications, the
customer must submit all requested documents within 60 days from the date of purchase.
It is the customer’s responsibility to ensure that all required information and documentation
are provided accurately and within this timeframe. Failure to submit the required documentation
within 60 days will result in the order being deemed inactive and automatically cancelled.
In such cases, the payment made will no longer be valid, and no refund, credit, or transfer will be
issued under any circumstances. If the customer wishes to proceed after this period, a new order and
full payment will be required.
We accept no responsibility for delays caused by failure to provide required documents within the
stated timeframe.
6. Level 1 Health
& Safety Awareness Course
The Level 1 Health & Safety Awareness course is provided as digital content at a total cost of
£180, inclusive of VAT. Full payment must be made before access is granted.
By purchasing the course, you agree to receive immediate access and acknowledge that your statutory
14-day cancellation rights are waived once access is provided.
If cancellation is requested before accessing the course, a £60 cancellation fee will apply,
and the remaining £120 will be refunded within 3 to 4 working days. Once the course has been
accessed, it is strictly non-refundable and non-cancellable.
The course is licensed to a single user only and is non-transferable. Sharing, distributing, or
reselling course content is strictly prohibited and may result in termination without refund.
Certificates are issued upon successful completion of the course. We accept no responsibility for
delays caused by awarding bodies or incorrect information provided by the customer.
7. CITB Test Revision
Materials
CITB test revision materials are available in digital and physical formats at a cost of £25.
All purchases are non-refundable once payment has been made.
E-books will be delivered via email within 24 hours, and paperback materials will be delivered within
7 to 10 working days. Delivery times are estimates and may vary due to circumstances beyond our
control.
We accept no responsibility for delivery failures due to incorrect information provided by the
customer or delays caused by postal services. All materials are for personal use only and may not be
copied, reproduced, or distributed without permission.
8. Payments and
Pricing
All payments must be made in British Pounds Sterling (GBP) using approved payment methods. Full
payment is required before any service is provided. Upon successful payment, an order confirmation
will be sent via email.
We reserve the right to change pricing at any time without prior notice.
9. Provision of
Services
Our services are deemed to commence immediately upon receipt of your order and payment. By placing an
order, you provide us with authority to begin processing your request without delay. Once service
provision has commenced, cancellation may no longer be possible.
10. Limitation of
Liability
To the fullest extent permitted by law, Construction Worker Assistance shall not be liable for any
direct, indirect, incidental, or consequential loss or damage arising from the use of our services
or website.
This includes, but is not limited to, loss of earnings, missed opportunities, or business losses. Our
total liability shall be limited to the amount paid by you for the specific service in question.
11. Third-Party
Disclaimer
Construction Worker Assistance operates independently and is not affiliated with CITB, CSCS, or any
government or regulatory authority. All decisions regarding tests, certifications, and applications
are made solely by the relevant organisations.
12. Force Majeure
We shall not be held liable for any failure or delay in performance caused by events beyond our
reasonable control, including but not limited to technical failures, strikes, pandemics, government
actions, or postal disruptions.
13. Data Protection
and Privacy
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and
the Data Protection Act 2018. By using our services, you consent to the processing of your personal
data for service delivery and communication purposes.
14. Misuse and
Termination
We reserve the right to suspend or terminate any order or service without refund where we reasonably
suspect fraud, misuse, or breach of these Terms and Conditions.
15. Amendments
We reserve the right to amend or update these Terms and Conditions at any time. Continued use of our
services constitutes acceptance of any revised Terms.
16. Governing Law and
Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England
and Wales. Both parties agree to submit to the exclusive jurisdiction of the courts of England and
Wales.
